There is no disciplinary provision for appealing a decision of the Judicial Council. All decisions of the Judicial Council are final.

Statement of Facts


At its annual session in June, 2000 the North Carolina Annual Conference adopted a resolution pertaining to a call for the churches in the Conference to seek the leading of the Holy Spirit through study and prayer on the issue of homosexuality using the denomination's official study materials and the Social Principles. The Conference requested a declaratory decision on the resolution.

The Judicial Council ruled that the matter did not meet the requisites for a declaratory decision and declined to assume jurisdiction to consider it as such.

At the 2001 session of the Annual Conference a clergy member of the Conference moved to "appeal the Judicial Council's decision." The Conference sustained that motion, which was forwarded to the Judicial Council for its consideration.

Paragraph 2609.10 states in part: "All decisions of the Judicial Council shall be final." There is no disciplinary provision for appealing a decision of the Judicial Council.
